ACTIVE ELITE TERMS AND CONDITIONS

This document sets out the Terms & Conditions of the Lorna Jane Active Elite Program provided by Lorna Jane USA, Inc. (“Lorna Jane”). These Terms & Conditions are intended to protect the Member and Lorna Jane and are applicable to the Member throughout their Active Elite membership, which is renewed on an annual basis.

Any failure or delay by Lorna Jane in exercising its rights under any of these Terms and Conditions does not constitute a waiver of those rights by Lorna Jane. Any waiver by Lorna Jane must be in writing and signed by an authorized officer of Lorna Jane. If Member does not understand the Terms & Conditions, or if Member has any questions, please call our Lorna Jane Customer Care Team at 1 800 469 3897.

 

QUALIFICATION

The Lorna Jane Active Elite Program is exclusively available to fitness professionals engaged in active employment within the fitness industry as an instructor within the United States.

Proof of this employment must be verified prior to acceptance by providing Lorna Jane the below details through the provided form at www.lornajane.com/joinactiveelite

If employed by a business, one of the below must be provided:

• Dated letter from employer on business letterhead stating employment
• Copy of a current printed business card
• Employer’s details for phone reference
• Personal Training Certification or equivalent certification

If self-employed, the below must be provided:

• Website
• Copy of a current printed business card

Membership in the Lorna Jane Active Elite Program is valid for 12 months from the date of joining the program. In order to retain membership status, applicants must retain active employment in the fitness industry and have made at least three purchases within the last calendar year. Upon expiry the Active Elite member can re-apply.

Lorna Jane reserves the right to request additional information or refuse acceptance in to the Active Elite Program should the information and/or documentation provided not be deemed sufficient to prove active employment in the fitness industry as an instructor within the United States.

 

PROGRAM ACCEPTANCE

After submitting the required verification details, you will receive confirmation of your membership status, if you are accepted into the Active Elite Program, which will be sent electronically to the e-mail provided in your application.

Following program acceptance, you can redeem your Active Elite discount by:
• Presenting your photo ID in-store
• Logging in to your account to redeem

 

MEMBERSHIP BENEFITS

The benefits applicable to the Member of the Active Elite Program are outlined below and only available to that member during membership validity. To redeem an Active Elite Member specific promotion in a Lorna Jane retail store, a photo ID must be presented. To redeem an Active Elite member specific promotion online, the account associated with the membership must be logged into, and the discount will be applied at checkout.

If photo identification is not presented at time of purchase in store, Lorna Jane will not honor any Active Elite membership benefits or promotion in that transaction. Equally, if proof of membership is not provided and full price is charged for product, Lorna Jane will not credit or refund any difference once the transaction has been processed. Please contact your nominated retail store with any questions surrounding this. The Active Elite discount cannot be combined or used in conjunction with any other promotions or offers, or applied to sale product. The Active Elite discount is applicable to full price merchandise only.

Additional exclusive offers may be communicated by mail, e-mail, SMS, Facebook or in a Lorna Jane retail store. Terms and Conditions to such promotions should include details including, but not limited to, purchase requirements, further eligibility requirements and time frame of promotion validity. Please note, in order for a Member to remain active, the Member must make three transactions per year.

USA ACTIVE ELITE PROGRAM BENEFITS

The below benefits are available exclusively for members of the Active Elite Program and cannot be extended to those outside of the program, unless stated otherwise.

• Exclusive Active Elite discount on all full priced Lorna Jane products
• Invitations to contribute and be featured across the Lorna Jane brand community with a global audience of over 3 million active women

 

TERMINATION

Lorna Jane reserves the right to suspend or terminate one’s membership in the Lorna Jane Active Elite Program immediately if Lorna Jane reasonably believes that the Member has breached these Terms and Conditions.

Should the Member wish to terminate his or her membership to the Active Elite Program, Lorna Jane requires formal written communication containing the below information. Upon receipt of communication, Lorna Jane will terminate your membership to the Active Elite Program immediately.

• Reason for Termination

LORNA JANE ACTIVE ELITE PRIVACY CARD NOTICE

The following contains important privacy information for the Lorna Jane Active Elite Program member. This privacy notice is provided to you by Lorna Jane Pty Ltd and contains important information regarding the collection, use, disclosure, security and access of your personal information

 

COLLECTION OF PERSONAL INFORMATION

The information Lorna Jane collects includes:

• Contact Information provided by you to Lorna Jane.
• Transactional information when you shop using your Lorna Jane Active Elite membership benefits such as, but not limited to, the store(s) the Member shopped at, when the Member shopped, the Member’s purchases and method of payment.
• Information that we may gain from other sources relevant to the Lorna Jane Active Elite Card Information the Member may provide from time to time through contact with the Lorna Jane Support Center or information the Member provides when using on the Lorna Jane website.

 

USE, DISCLOSURE AND PROTECTION

The Member’s personal information will be protected through confidentiality agreements and other contractual obligations where disclosed. Lorna Jane collects this information and may use this to keep the Member informed about special promotions, events, product launches and other special offers and discounts, relevant to the Lorna Jane. Lorna Jane will take all reasonable steps to ensure the Member’s personal information is protected from unauthorized access, misuse, modification and disclosure while stored by Lorna Jane. Lorna Jane may also use the Member’s information for research, marketing and product and service development.

 

ACCESS OR CHANGE PERSONAL DETAILS

It is the Active Elite member’s responsibility to ensure that Lorna Jane is provided with correct and updated personal information to receive full benefits of the program.
